WASHINGTON (Washington Insider Magazine)- The latest step in her civil suit, which accuses former President Donald Trump of engaging in years-long fraudulent activities, was taken on Thursday when New York Attorney General Letitia James submitted court documents asking the judge to stop the transfer of assets from his namesake real estate firm.
Six days prior to James’ office filing the lawsuit, the application for a preliminary injunction claims that executives of the Trump Organization established a new Delaware business with an identical name. On September 21, the day the civil lawsuit was filed, the organization then submitted the necessary papers to register Trump Organization II LLC in New York.
The Trump Organization’s attorneys reportedly informed James’ office that the business had not taken any measures to avert the implications of the lawsuit and proposed to provide “assurances and advance notice” to allay any worries, according to the motion filed in New York Supreme Court. However, the Trump Organization lawyers failed to present a “concrete mechanism” to implement the offer, the court document said, so James asked a judge to step in.
Trump’s attorney, Alina Habba, claimed in a statement that the motion is simply an underhanded attempt to keep the lawsuit with Justice Engoron instead of moving it to the Commercial Division, where it belongs.
The state Supreme Court, which serves as the primary trial court in New York, is presided over by Justice Arthur Engoron.
Requests for a response from a representative of the Trump Organization were not immediately answered.
Following her civil probe of the Trump Organization’s business operations, James filed a lawsuit against Trump, his 3 eldest children, as well as the Trump Organization around three weeks ago, according to NBC NEWS.
James accused Trump of committing more than 200 frauds over a ten-year period and exaggerating his own net worth to secure advantageous credit deals.
James’ office is demanding a 5-year ban on Trump and his company’s commercial real estate purchases in the state as well as a permanent ban on members of the Trump family holding officer positions in New York-based corporations. Additionally, she is asking for penalties of around $250 million.
Trump’s attorneys earlier rejected the lawsuit as a politically driven attack that was neither fact- nor law-focused. It was the “culmination of over 3 years of persistent, targeted, unethical political harassment,” according to a spokesperson for the Trump Organization.
Additionally, James’ office is asking for the court’s approval to serve Eric Trump and Donald Trump electronically. She said that for nearly a month, the two men and their attorneys had resisted accepting service of the complaints.
James’ motion also asks for the appointment of an impartial monitor to ensure compliance with those requirements and that any additional financial declarations to insurers and banks contain all relevant supporting documentation.
