US (Washington Insider Magazine) -In a landmark decision, the U.S. Supreme Court ruled on Monday that former President Donald Trump has partial immunity from prosecution for actions taken while in office. The ruling stems from criminal charges Trump faces related to his efforts to overturn the 2020 elections during the final days of his presidency.

The court’s decision allows Trump to claim immunity for “official actions,” meaning he cannot be prosecuted for conduct related to his presidential duties. However, Chief Justice John Roberts emphasized that this does not grant the president blanket immunity, stating, “The President enjoys no immunity for his unofficial acts, and not everything the President does is official.”

Legal experts warn that this ruling could fundamentally alter the balance of presidential power, with some arguing it creates a dangerous precedent that may undermine the rule of law. David Super, a law professor at Georgetown University, remarked that the decision could empower future presidents to act with impunity, likening it to powers typically seen in dictatorships.

The ruling, supported by the court’s six conservative justices, is expected to delay Trump’s ongoing criminal cases until after the upcoming presidential elections, as a lower court must first define what constitutes an official action.

Critics, including liberal Justice Sonia Sotomayor, voiced strong opposition to the ruling, suggesting it effectively insulates the president from accountability. She warned, “When he uses his official powers in any way… he now will be insulated from criminal prosecution,” raising hypotheticals about potential abuses of power, such as ordering military actions against political rivals.

Experts also expressed concern that the ruling could endanger the independence of the Justice Department, which has traditionally operated free from political interference. The court’s designation of Trump’s communications with Justice Department officials as “official actions” raises alarms about potential executive overreach and manipulation of justice.

Political historians noted that Trump is not the first president to push the boundaries of immunity. Previous presidents, including Richard Nixon and Ronald Reagan, faced their own controversies but avoided criminal charges. However, Trump is unique in that he currently faces multiple criminal indictments, which he dismisses as a “witch-hunt” orchestrated by political opponents, particularly President Joe Biden.

As the political landscape shifts with this ruling, the implications for the upcoming elections and the future of presidential accountability remain uncertain.
