Death of 34-Year Old Man

A 34-year-old man has died of a blow to the head after he was pushed onto the New York subway tracks during an altercation with an ex-convict at a Manhattan station early yesterday morning.

Police arrested the suspect, identified as 28-year-old Andre Boyce. He was charged with manslaughter and has a history of mental health incidents with the NYPD.

According to police, who were on patrol, the incident occurred at the 96th Street and Broadway 1/2/3 Line station on the Upper West Side just before 2 a.m. of Friday.

The victim had been involved in a dispute with Boyce, a young man with apparent mental problems who pushed him onto the tracks, Pix11 detailed. When he fell, he sustained a serious head injury. He was transported by paramedics to St. Luke’s Hospital, where he died.

The victim and the suspect were involved in sexual activity on a No. 2 train to Downtown and began fighting, multiple police sources told the Daily News. For that reason the driver ejected them both upon reaching the W. 96th St. station and used his horn to alert the NYPD.

Meanwhile, the fight continued and Boyce locked the other man in a headlock and threw him onto the tracks of the No. 1 train, hitting his head as he fell. Police officers patrolling the station witnessed the incident and quickly seized the alleged assailant and sent the victim to the hospital, where they were unable to save him.

Boyce had been released from prison in March of last year after serving nearly seven years at the Sing Sing Correctional Center for attempted robbery, state Department of Corrections (DOC) records show. He was under post-release supervision with an expiration date of May 2026.

He, too, was locked up in 2012 for another attempted robbery for a year before being released on parole, the New York Post noted.

“Twenty-two people were pushed onto subway tracks in New York last year through mid-October, according to police statistics,” The New York Times quoted.

Since taking office a year ago, former NYPD Mayor Eric Adams has announced multiple times that he would double the number of NYPD officers in the subway system in a beefed-up security plan to deal with violence in the chaotic NYC subway. But so far crime has continued to rise.

On Sunday an 80-year-old Hispanic man was robbed and beaten at a Brooklyn subway station and on Thursday an off-duty New York police officer (NYPD) was robbed at knifepoint on a New York City train. L line when traveling through Brooklyn.

At the same time, MTA faces millions in losses due to the increasing number of users who access the Metro and buses without paying. In addition, it is estimated that some 3,400 homeless people are currently living in subway cars and stations.
