Joseph DeVito, a 61-year-old man, died when he was struck by a driver who was intoxicated leaving a restaurant in Woodbury, Long Island (NY).
Willem Specht, 62, was arrested on suspicion of causing the fatal accident while drunk driving.
Nassau County detectives responded to the parking lot of the On Parade Diner in Woodbury around 2:30 p.m. on Wednesday. According to the initial investigation, Specht backed up his car and struck DeVito, who had just left the business.
Court documents say Specht’s car skidded off the sidewalk, crashing into the victim who was pinned under the car and impaled on the handicap railing, News 12 described.
DeVito, a Wantagh resident, suffered severe trauma and was rushed to the hospital. He died about an hour later.
Police said Specht’s blood alcohol level was more than triple the legal limit. He was charged with driving while intoxicated, manslaughter and reckless endangerment. He was held on $250,000 bond and is scheduled to return to court on Monday, January 23.
All charges are mere accusations and those charged are presumed innocent until proven guilty in court.
