(Washington Insider Magazine)-LOS ANGELES, California (Transatlantic Today) – According to a court document filed on Friday, the late actor Bill Paxton’s family has decided to settle a wrongful death case against a Los Angeles hospital and the doctor who operated on his heart just before he passed away in 2017.
The trial for the lawsuit, which was brought against Cedars-Sinai Medical Center more over 4 years ago, was set to begin next month. However, lawyers for Louise, Paxton’s wife of 30 years, and their 2 children, James and Lydia, filed a declaration in Los Angeles Superior Court indicating that they had reached a settlement.
Bruce Broillet and Steve Heimberg, attorneys for the plaintiffs, declared in a statement that the case has been addressed to the mutual satisfaction of the parties.
The attorneys claimed that the terms are private. The defendants did not promptly respond to emails requesting comment. A court must still approve the agreement.
Paxton, who acted in television shows like “Big Love” and movies like “Aliens,” “Apollo 13,” and “Titanic,” passed away on February 25, 2017.
According to his death certificate, a stroke occurred 11 days after a heart valve replacement and aorta repair procedure.
A year later, a complaint was filed alleging that Dr. Ali Khoynezhad, the surgeon, had minimized the risks of the treatment while performing an unneeded “high risk and unconventional surgical approach” for which he lacked the essential training.
According to the lawsuit, Paxton experienced severe bleeding, cardiogenic shock, and a damaged coronary artery as a result of the negligent treatment. Cedars-Sinai was aware that Khoynezhad frequently engaged in maverick procedures and showed suboptimal judgment, the lawsuit claimed.
In court records, the defendants claimed that Paxton and his family were aware of the risks associated with the surgery and freely underwent it. His death, according to the accused, was not the result of any negligence.
The Paxton family made repeated attempts to obtain additional discovery information from the hospital throughout the 4-year court case, and there were several hearings on the subject, according to NBC NEWS.
From the early 1980s until his passing, Paxton, who was born and raised in Fort Worth, Texas, was one of the busiest actors in the business, garnering approximately 100 credits, including “Weird Science” and “Twister.” He passed away while starring in the CBS drama “Training Day.”
